The majority of people who receive medical attention from healthcare professionals are treated effectively. Unfortunately, there are rare occasions when things go wrong, causing injuries which should have been avoided.
The impact of medical negligence can be life-changing. You may need answers and you may be eligible for significant medical negligence compensation.
Whatever path you take, we are here to help you towards a more positive future. If you think you have suffered negligent treatment, our highly respected team of medical negligence experts is here to support you to move forward with your life.
Our medical negligence solicitors have extensive experience and have been responsible for obtaining significant awards of compensation for injuries and losses suffered by clients. These range from relatively modest delays in treatment to birth and brain injury cases of the utmost complexity and value - running into the millions.
Our compassionate medical negligence solicitors take the stress out of making a medical negligence claim, plainly explaining each stage without the legal jargon. Using their extensive experience and knowledge, they’ll assess your claim and work towards the best outcome.
We’ll work hard to settle your claim outside of court and, where this may not be possible, we’ll be with you every step of the way.
The first step is to get in touch with our medical negligence solicitors. We are here to have a no-obligation discussion with you about your concerns. We can advise on the most appropriate steps forward, which may be to commence a claim. We will ask you details about the treatment you received and understand where your concerns lie.
If appropriate, your solicitor will advise on the best funding options for your case, whether that’s through legal aid or on a no win, no fee basis.
If we are instructed, our specialist team will investigate the case by:
Obtaining medical records
Obtaining independent expert evidence – to assess whether the care provided was appropriate, and if not, the consequences of that treatment
Investigating the longer-term physical, psychological, and financial impact of any negligent treatment – sometimes referred to as condition and prognosis
From here, our solicitors will act on your behalf in presenting a claim to the defendant on your behalf. Sometimes a settlement can be reached without having to resort to court proceedings.
However, if it is not possible to reach an agreement, we will be there for you throughout the litigation process.
If a successful conclusion is reached, our medical negligence solicitors can, where appropriate, provide support for you in managing the compensation sum, whether that is through our private client department with personal injury trusts, our Court of Protection team and professional deputyship, or appropriate referrals for independent financial advice.
Our professional and caring team will assist you in navigating the challenges of living with the aftermath of medical mistakes. You will receive sound advice on the best course of action, as well as ongoing support through access to specialist rehabilitation (in cases where we receive an admission of liability).
We’re one of few local firms to offer legal aid, helping you to access the justice you deserve. Our strong regional reputation has been built over years of successfully supporting people to rebuild their lives through compensation and providing access to ongoing support and rehabilitation. You’re in safe hands with us.
By speaking with us, you will be sharing your situation with the best minds. Our department head, Jonathan Baker, has been recognised for his expertise in the UK’s most well-respected legal guide for achieving ‘fantastic results for his clients' and is accredited to the Law Society’s Clinical Negligence Scheme.
We are members AvMA Lawyers’ Service, a charity for patient safety and justice; and Headway, a UK-wide charity that works to improve life after brain injury by providing vital support and information services. Some of our team also have membership with the Association of Personal Injury Lawyers, a not-for-profit organisation that fights for the rights of victims of injuries.
Our focus is to help you. If appropriate, we can arrange for specialist rehabilitation experts to be involved in your care and to support you in your recovery.
In cases where we have an admission of liability, we can either arrange for the defendant’s representatives to pay for your care under the rehabilitation code, or we can organise for an interim payment to be made by the defendant themselves. The complexity of medical negligence claims, coupled with the large sums of compensation involved, often creates a need for broader legal support. Our colleagues can help you.
For example, solicitors in our dedicated Court of Protection team often act as professional deputies in some of the multi-million pounds claims we have brought.
Our private client team also provide support with Wills, Lasting Powers of Attorney, and personal injury trusts, as well as referring clients to reputable and experienced financial advisors.
We help clients recover from medical negligence incidents every day.
Here are the most common questions we receive in regard to medical negligence cases.
Generally speaking, you have three years from when the negligence occurs, or the date in which you have knowledge of the evidence, to make a claim.
There are some exceptions to this, such as in cases involving children or those who lack mental capacity, and where treatment results in death.
If you are unsure whether you have time to make a claim, get in touch as soon as possible.
Most of the work that we do is through 'no win, no fee' agreements, but there are other funding options available, including legal aid where appropriate.
There are limited circumstances where you may be eligible for legal aid – we’re one of few local firms to offer this funding option to clients. It is only available for birth-related brain injuries or brain injuries occurring in the first six weeks of life.
It is possible to bring a claim by yourself, but this is not something that we recommend. Medical negligence cases involve complex medical and legal issues and can be expensive to fund alone.
We will discuss the options with you to see what is available.
There are many stages of a medical negligence case and going to court is seen as a last resort. Most cases do not reach this stage, usually through a negotiated settlement.
Submit an enquiry and one of our team of experts will be in touch as soon as possible to discuss your needs.
