Temporary change to fit note requirement for SSP

As the UK continues to feel the effects of the Coronavirus pandemic, and with the increasing effect of the new Omicron variant, the Government continues to make changes to try and keep ahead of the curve.

One such change includes a new amendment to the rules regarding an employee’s requirement to provide a GP “fit note” for any period of incapacity for work. The standard rule requires such medical evidence to be provided by an employee to cover any period of absence which lasts longer than 7 days. Under new legislation introduced on 17 December 2021, this period has been temporarily extended to 28 days.

This means that an employee can now self-certify their absence for 28 days before an employer can request a fit note. The change is only temporary however, and only applies to absences which began on or after 10 December 2021, up to and including 26 January 2022. Any absence beyond the new 28-day period will still require a fit note.

The aim of this provision is to free up GP’s to assist in the COVID-19 booster programme which is designed to tackle the Omicron variant. Currently, the 7 day period will be reinstated in respect of any absences which start after 26 January, however given the uncertainty we currently face with the pandemic, there is scope for this provision to be extended. Employers may therefore wish to consider how they approach this change and their absence reporting requirements.
