Tom Martin is a senior associate in the employment law team based in our Lincoln office.
He advises both employers and employees on all aspects of employment law, offering practical commercial advice designed to achieve the client’s desired outcomes.
Tom often advises on day-to-day problems such as disciplinary and grievance issues, employment contracts, policies and procedures, performance and sickness absence management, and Settlement Agreements.
He also advises on more technical issues such as redundancy and restructuring procedures, IR35 compliance, data protection matters, restrictive covenants, and TUPE transactions. He further handles employment tribunal claims involving unfair dismissal, discrimination, and whistleblowing.
Key specialisms
Education sector
He takes a comprehensive and holistic approach to all legal issues that schools, academies, multi-academy trusts (MATs), nurseries, further education colleges, and universities may face in the education sector.
Previous support he has provided to schools included advising on TUPE transactions and academy conversions, facilitating proper teacher wellbeing and management, and assisting with the review and implementation of new policies and procedures.
Military expertise
Military employment law is dramatically different in a number of ways compared to a civilian employee. Tom specialises in advising military personnel and veterans on armed forces and military employment law to ensure individuals rights are protected.
This includes providing advice and assistance on issuing service complaints in respect of unfair treatment suffered by military personnel, disciplinary and administrative action which may lead to discharge, and advising on the merits and practicalities of early release applications.
Immigration for businesses
Tom also regularly provides advice to businesses on matters of international recruitment. The Immigration Rules in the UK can be complex and difficult to navigate but provides far greater access to the talent market if properly utilised.
Tom can assist businesses with practical guidance and advice on sponsor license applications, sponsor compliance (once a license has been granted), and right to work checks.
Voluntary work and memberships
Tom regularly delivers internal and external seminars on a broad range of employment topics, as well as bespoke training to businesses.
Qualifications
Tom graduated from the University of Nottingham in 2013 with a 2:1 degree in law and completed his Legal Practice Certificate, with a distinction, from Nottingham Law School in 2014. Tom qualified as a solicitor in September 2017, having completed his two-year training contract with the firm, and has worked exclusively for the employment team since.
