Asbestosis claims

Asbestosis is a chronic (long term) lung condition caused by inhaling asbestos dust fibres. Exposure to asbestos over a long period of time can cause scarring of the lung tissue.

For asbestosis to develop, prolonged exposure to relatively high numbers of the fibres is necessary.

Common asbestosis symptoms include:-

  • Shortness of breath

  • A persistent cough

  • Wheezing

  • Fatigue

  • Chest pain

Asbestosis FAQs

  1. How much compensation am I likely to recover?

How much compensation you receive for a diagnosis of asbestosis will depend on a number of different factors including the severity of symptoms, the impact it has on your life, and your age at the date of diagnosis. Your personal circumstances will be taken into account so each patient will receive an amount dependent on their particular situation.

Damages can be recovered  for the illness itself, as well as financial losses incurred as a direct result of the illness such as the cost of care (whether that’s provided by friends and/or family or provided on a professional basis), adaptations to the home and any other losses incurred as a direct result of your illness.

  2. What if the company which exposed me to asbestos no longer exists?

As long as the employer who negligently exposed you to asbestos had insurance at the time you were exposed (something which a specialist solicitor would be able to discover) then you will be able to bring a civil claim for compensation, even if the company no longer exists.

  3. Are there any time limits for bringing an asbestosis claim?

Claimants usually have three years from the date of diagnosis to bring a claim for asbestosis, however our specialists will be able to provide specific advice for your particular situation.

  4. Are there any state benefits which I may be entitled to as a result of my asbestosis diagnosis?

You may be entitled to state benefits following a diagnosis of asbestosis. Our experts will be able to provide guidance on entitlement.
