Victoria Quinn is a partner in the dispute resolution team based in our Beverley office.
Victoria is a member of the Property Litigation Association and has extensive experience in all aspects of real estate litigation, with a focus on licenced leisure and retail portfolios.
Her work typically involves Landlord and Tenant Act 1954 lease renewals, leasehold covenant enforcement (current and former parties), and estate management issues involving breaks and option notices, and recovering possession.
Victoria also advises clients in relation to the Electronic Communications Code, advising both operators and site providers regarding the Code and the deployment of infrastructure.
Key specialisms
Portfolio lease renewals
Victoria regularly acts for both landlords and tenants in connection with lease renewals, both opposed and unopposed. Having acted on such matters in excess of 20 years, she is adept in all aspects of the process and strategizing the same from both parties' perspectives.
In relation to unopposed lease renewals, a strategic approach can be taken to complete the lease renewal process efficiently and cost-effectively, along with use of alternate dispute resolution, such as Professional Arbitration on Court Terms (PACT).
Having worked for both landlord and tenant portfolios, Victoria is alive to the challenges and issues relating to the statutory grounds of opposition under the Landlord and Tenant Act 1954 and the benefits of timely resolution of the same, particularly where redevelopment or own use and occupation of the subject property is the key ground of opposition.
Leasehold covenant enforcement
From both a landlord and tenant perspective, she progresses all types of claims enforcing lease covenants. From recovering rent arrears (from tenants and guarantors, both current and former), enforcing disrepair and dilapidations (interim and terminal), issues of consents relating to alienation and alterations to the termination of leases and recovering possession.
Victoria is involved in cases in both the County Court and High Court but strives to resolve the issue(s) in both a cost and time effective manner.
Estate management
Victoria successfully managed significant break projects for numerous retailers over the COVID-19 pandemic and thereafter. She advised on the applicable conditions, service of the notices, and the yielding up of the property.
Today, her work sees her advising on all issues relating to the management of an estate/property portfolio - be it strategic advice in contemplation of development/redevelopment or change of use. She further advises on actions relating to restrictive covenants, rights of way, easements, rent reviews, options (break purchase and renewal) and adverse possession.
In addition, she also acts in relation to trespass and squatter evictions in both the County and High Court.
Telecommunications
Victoria regularly advises operators concerning the Electronic Communications Code and the rollout of their infrastructure in, on, or over land as well as in properties (to include multiple dwelling units). She progresses claims through the tribunal to obtain code leases and agreements.
In addition to acting for operators, Victoria also acts for site providers regarding all aspects of the Code.
