Bursting at the seams: real estate help for schools

The scenario

The new housing estate nearby means you’re rapidly outgrowing your current buildings, and you’re considering putting up a new block to help ease the pressure at the school.

  • Is the land actually in your ownership (either as part of your lease, or freehold)?   

  • Check your lease if you have one – it will limit if and how you can put up new buildings

  • Do you need planning permission?  Get some proper planning advice, whether from an architect, your lawyer or a formal planning consultant

  • Make sure you have a contract in place with whoever does the construction work to cover you for anything that goes wrong

  • Keep copies of all planning permissions and building regulation certificates handy, you’ll need them in the future

What not to do

  • Don’t let anyone start building, demolishing, or site clearing without having all appropriate consents in place beforehand:

    • landlord

    • Department for Education (DfE)

    • planning permission might be required

  • Never agree to pay a builder ‘off the books’ to avoid VAT
